New trial set in Neo Nazi case
www.examiner.com – After a mistrial was declared late Thursday evening, a new trial has been set for accused Neo Nazi murderer John Ditullio. The new trial is set for March 22, 2010. John Ditullio is charged with murder in the first degree and attempted murder of Kristofer King and Patricia Wells. The attack took place on March 23, 2006 in New Port Richey (see back stories for case information).
The first trial drew nationwide attention and controversy as the Judge had granted an order requesting that John Ditullio’s tattoos be covered with makeup so not to prejudice the jury. The makeup artist was commissioned at $150.00 per day, at taxpayers’ expense. It is expected that the makeup artist will be commissioned for the new trial.
On Friday, December 11, 2009, 12 jurors failed to agree on a verdict and voted 10-2 with the majority in favor of acquittal. Deliberations lasted nearly 10 hours, but they reached an impasse. The jury returned at approximately 11:00 p.m. and a mistrial was declared by Judge Michael Andrews.
The trial saw several surprises, one including testimony by Samantha Troop who stated that another man, Shawn Plott, had confessed to her that he was the killer.
John Ditullio appeared in court today for the announcement of the new hearing. The makeup artist did not cover his tattoos.
