New lawsuit targets Hogans

www.myfoxtampabay.com – The family of John Graziano is asking that a jury be allowed to consider punitive damages against the family of Nick Bollea, also known as Nick Hogan.

Attorney George Tragos filed the lawsuit late Wednesday.

Graziano’s family is already suing the Bolleas for the lifetime of medical care that Graziano will require, but this lawsuit is asking for a yet-to-be announced amount of money to punish the Bolleas.

“The sole purpose of this is to punish and to be an example to others. The fact of the matter is, of course, that the dollars do go to the plaintiff,” said Stetson law professor Lee Coppock.

Coppock says punitive damages are rare in civil cases between individuals, because most people don’t have a lot of assets.

“Take someone who has significant assets on the other hand, and it’s worth pursuing it,” he said.

To make the case for punitive damages, Graziano lawyers have compiled 54 pages of evidence. First, noting Nick Bollea’s many speeding tickets.

Claims also include Nick’s celebrity parents allowed him to drive before he had a license; that mom and dad were aware he had a quote “lead foot,” plus an analysis that shows Nick’s blood alcohol level the night of the crash was likely double the first measurement.

The Grazianos just settled with Linda Bollea, who is now divorced from her wrestler husband. The new filing specifically takes aim at Hulk Hogan, aka Terry Bollea.

It argues: “it is evident that Terry Bollea knew of his son’s pattern of breaking the law…and failed to take appropriate action to curtail his son’s reckless driving.”

John Graziano’s attorneys also argue that Hulk Hogan bought his 17-year-old son beer the day of crash and let him drive. The filing concludes: “this act alone demonstrates gross negligence.”

The court will consider the filing, but cannot do anything for at least 20 days.

    Everyone should just leave the Hogans alone.Nick did his time for what he did.I guess people are in the need for sueing peopole.Greed shouldnt be the point.We all should forgive eachother,help out another.My blessings are with both families.
