Misty Croslin Attorney: Joe Overstreet Took Haleigh Cummings

PUTNAM COUNTY, Fla. — After Misty Croslin was in court on a drug charge Tuesday, her attorney opened up about what happened the night the 5-year-old disappeared.

Robert Fields, Croslin’s attorney, revealed details about what his client was doing when Haleigh vanished in February 2009.

Fields said Croslin told him that Joe Overstreet, her cousin who lives in Tennessee, was involved in Haleigh’s disappearance.

Misty Croslin was watching Haleigh and Ronald Jr., the children of her boyfriend, Ronald Cummings that February night.

According to Fields, Joe Overstreet and Tommy Croslin, Misty’s brother, were also at the mobile home.

Fields said Overstreet was looking for a machine gun that Cummings owned.

When Overstreet couldn’t find the gun, according to Fields, he took out his frustrations out on Croslin, which included pushing, shoving and sexual groping.

Fields said that Overstreet then headed for Haleigh. Then Misty Croslin and Ronald Jr. hid under some covers. They were able to hear Haleigh screaming, struggling and crying, he said.

According to Fields, Croslin said Haleigh became quiet and she saw Overstreet put her in a black cloth bag.

As Croslin again hid under the covers with Ronald Jr., she said she heard the house door open and close several times, then the sliding door on a van opened and closed.

Fields said Croslin remained under the covers for quite a while after that, scared.

Croslin told police her brother Tommy did nothing to Haleigh, and that everyone in the family is scared of Overstreet.

Fields say Croslin told investigators this information after she was arrested in January.

Haleigh remains missing.

Her seventh birthday is today.

The Putnam County Sheriff’s Office this afternoon said their main concern remains locating Haleigh Cummings, and offered no further comment related to Fields’ story his client gave him.

A call to Overstreet’s attorney has not been returned.

Overstreet has been the subject of police interrogations in the case, but hasn’t been arrested in connection with the Feb. 2009 disappearance.

He was arrested in Tennessee earlier this month on drug charges, however.

Before today, Croslin has said she put Haleigh to bed that night, and when she woke up, the little girl was gone. But investigators have maintained during the year and a half of searching for Haleigh that Croslin hasn’t been completely truthful, and that she is the key to the case.

Misty Croslin withdrew “not guilty” pleas in the drug trafficking cases against her in Putnam and St. Johns counties this week. She has pleaded “no contest” in both cases and faces a minimum mandatory sentence of 25 years in prison St. Johns County. She could face up to 240 years for her similar plea Monday in the Putnam cases.
