Man had ‘contract’ with molestation victim, police say
NEW PORT RICHEY – On Monday, a 14-year-old girl learned she was pregnant after taking an in-school pregnancy test. On Tuesday, she told city police the father could be one of two people, including a 70-year-old man. That same day, police arrested him.
Richard Frank Michaelis, 5340 Charlotte Ave., was arrested by a New Port Richey police detective, accused of raping and molesting the teen.
For two months, the girl told Detective Jason Engel, she was “taught” by the man about her private body parts. While she was naked, Michaelis touched her and identified different parts, his arrest affidavit states. He also showed her various sexual positions and demonstrated to one degree or another, police say. During the demonstrations neither had pants on, according to the affidavit.
The girl told the detective that one of the incidents occurred during the past week. She was awakened to Michaelis touching her, she told him to stop and then she ran into the bathroom, the affidavit states.
The pair also had a contract about their sexual relationship, according Engel. The girl told authorities it was hidden in the kitchen and that’s where it was found.
It states that in the past Michaelis willfully had sexual encounters with the girl. It also states that he agreed to “abandon” sexual contact with her and she was supposed to abstain from sex with anyone until marriage.
“The terms were he would stop as long as she would behave,” Engel said today.
Under a section titled “nullification of contract terms,” the document states that if he violates the contract, she could surrender it to her mother. But if she violated it, he “has the right to use the victim’s body at his discretion,” Engel wrote in the affidavit.
It also addressed the issue if she went to police, Engel said.
“If she were to go to the authorities, then he would accuse her of instigating sexual activity.”
That seems to be what happened.
When the detective interviewed Michaelis, he admitted to the sexual encounters but said he awoke to the girl in his bed fondling him. He also told the detective that when he awoke he stopped the contact. He denied having intercourse with her. He admitted, however, to ejaculating once during one encounter, the affidavit states.
Michaelis, according to the affidavit, admitted teaching the teen about body parts and acknowledged a contract, stating that they both signed it. He used it, according to the affidavit, as a threat to keep her out of trouble and from having sexual encounters with other teenagers. He also admitted he might be the father of her child.
Engel said it’s not yet known whether Michaelis is the father of the teen’s unborn baby. The girl has said she also had sex with a teenage boy, he said.
Michaelis is being held without the Land O’ Lakes Jail on charges of sexual battery and lewd and lascivious molestation.
Engel said the case is still being investigated. They are looking into the possibility of more victims, he said. The relationship between the girl and Michaelis is being withheld as to not identify the victim.
