(People Magazine) NEW YORK – Sofia Vergara has broken her silence on former fiancé Nick Loeb’s fight for her frozen embryos, saying his lawsuit “makes no sense.”

A child “needs a loving relationship of parents that get along, that don’t hate each other,” she told Howard Stern in an interview Monday.

“I don’t hate him,” she clarified, “but he obviously has a problem with me!”

Vergara, 42, and Loeb, 39, ended their engagement about a year ago, and the Modern Family star is now set to wed Joe Manganiello.

But Loeb is suing Vergara over two female embryos they created when they were together. The businessman outlined his stance in a New York Times op-ed last week, writing that he wants to implant them in a surrogate and become a single father.

“A kid needs parents,” Vergara said Monday “I wouldn’t imagine anyone saying that it’s sane to bring [into] the world kids that are already set up [with] everything wrong for them. It would be so selfish.”

The Hot Pursuit actress also argued that Loeb’s plan would violate a contract they both signed for each embryo.

“You signed papers, legal papers, and if it was so serious for him, this issue – which I totally respect it is serious for someone – then you should have taken it more serious at the time like I did,” she explained, adding that she’s not worried about a judge siding with her ex.

As for her current love life, Vergara said she doesn’t discuss the drama with Manganiello, 38.

“We try not to even talk about it,” she said. “We have lawyers, and we’re having so much fun right now. We’re moving to our new house, he’s promoting Magic Mike, I’m doing this movie, we’re planning our wedding.

“So it’s like, we try not to think about this because we can’t do anything. It’s signed, it’s done, we have a contract and that’s it.”
