Man says he accidentally shot girlfriend before kiss

Detectives did not believe Hayes' story.

(KOAT-ABC ALBUQUERQUE, New Mexico – An Albuquerque man is behind bars for a homicide he says was an accident.

According to police, Byron Hayes shot and killed a woman he was seeing. She was identified as Nichole.

According to court documents, Hayes claims Nichole was leaning into a car to kiss him when his gun accidentally went off Friday night near Carlisle and Montgomery boulevards.

Hayes told investigators he was going to take her to the hospital but she was already dead. Instead, he took her to his apartment where police found her body Saturday.

Police also found several bullet casings at the shooting scene that Hayes said were his.

Hayes is being held on a murder charge and for an outstanding child abuse warrant. He’s been held on a $500,000 cash or surety bond. Even if he makes that bond, he will likely remain in jail because no bond has been set for the child abuse case.
